Intellectual Property Litigation
Mr. Hemingway specializes in intellectual property litigation, principally in
patent cases across a wide variety of industries. These have included
pharmaceuticals, such as paclitaxel, fexofenadine, metaxalone, cyclosporine
and dexrazoxane; rolling mill drives; lithographic printing plates; laser-marking
silicon wafers; microwavable gel packs; high-energy loss fluid
control valves; herbicides; starch washing equipment; circulating fluidized
bed boilers and sputter-coating glass. Mr. Hemingway has represented
clients in Federal district courts and in the United States Court of Appeals for
the Federal Circuit in many cases resulting in reported decisions on novel
points of law. Notably, he participated in the Fromson line of cases, which
significantly contributed to the Federal Circuit's development of its initial
precedents in patent law.
Mr. Hemingway also advises clients on federal regulation of the
pharmaceutical industry.
